These Terms and Conditions govern access to and use of the website espitiafineart.com (the “Site”), as well as the purchase of products and services offered by Rafael Espitia Perea, an individual with principal place of business in Bogotá, Colombia, operating under the trade name Espitia Fine Art (hereinafter “the Gallery,” “we,” “our,” or “us”).

By accessing this Site and making any purchase or booking of services, you accept these Terms and Conditions in their entirety. If you do not agree with any part of these terms, please do not use the Site.

2. Products and Services

2.1 Original artwork

The Gallery offers limited edition paintings by Master Artist Rafael Espitia, created in acrylic on canvas, primarily in large format. Each artwork is original, signed by the artist, and includes a certificate of authenticity. The images published on the Site are photographic representations of the artwork. While we strive to display colors as accurately as possible, minor variations may occur due to screen calibration differences.

2.2 Custom artwork

The Gallery offers the possibility of commissioning custom artwork (Custom Artwork). The conditions, pricing, and delivery timelines for commissioned pieces are agreed upon directly between the artist and the buyer before work begins. Custom artwork is non-refundable once the creative process has started.

2.3 In-person classes and workshops

The Gallery offers speed painting classes (Espitia Method), personalized classes, and group demonstrations, all held in person at the Master’s studio in Bogotá, Colombia. We also offer courses on artificial intelligence applied to art, in both in-person and virtual formats. All classes and courses are conducted exclusively in Spanish.


3. Pricing and Currency

Prices for artwork are displayed in Colombian Pesos (COP) for the Colombian market and in US Dollars (USD) for the international market. The Site allows you to select your preferred display currency. The final transaction price will be the price shown at the time of checkout confirmation. Prices are subject to change without prior notice. Once a purchase is confirmed and paid, the agreed-upon price at the time of the transaction will be honored.


4. Payment Methods

We accept the following payment methods through our payment platform Wompi: credit and debit cards (Visa, Mastercard, and others accepted by Wompi), bank transfers and PSE, and other methods enabled by Wompi depending on the buyer’s country.

Payment processing is handled securely by Wompi. The Gallery does not store credit card data or sensitive financial information on its servers.

By making a payment, you confirm that you are authorized to use the selected payment method and that the information provided is accurate and complete.


5. Purchase Process

The purchase process for artwork is completed through the following steps: selecting the artwork on the Site; adding it to the shopping cart; entering shipping and billing information; selecting the payment method; and confirming and completing payment.

Once payment is confirmed, you will receive a confirmation email with the details of your order. The Gallery reserves the right to cancel an order if any irregularity is detected in the transaction, in which case a full refund of the amount paid will be issued.


6. Shipping and Delivery

6.1 Coverage

We ship to the entire United States and Colombia. All orders include free shipping, for both domestic and international deliveries.

6.2 Packaging

Each artwork is professionally packaged to ensure protection during transport. Packaging includes specialized art shipping materials, and all shipments are covered by transport insurance.

6.3 Estimated delivery times

Delivery times vary by destination. Shipments within Colombia are estimated at five (5) to ten (10) business days. Shipments to the United States are estimated at ten (10) to twenty (20) business days. These timeframes are estimates and may vary due to circumstances beyond the Gallery’s control, such as customs procedures or carrier conditions. The Gallery will provide the buyer with a tracking number for shipment monitoring.

6.4 International shipments

For shipments to the United States or other countries, the buyer is responsible for payment of any applicable import taxes, duties, and customs charges in the destination country. These costs are not included in the price of the artwork or in the free shipping offer.


7. Returns and Claims

7.1 General policy

Due to the unique and exclusive nature of the artwork, all sales are final. Returns are not accepted for change of mind, differences in color perception between the screen and the physical artwork, or decorative preferences.

7.2 Artwork damaged during shipping

If an artwork arrives damaged during transport, the Gallery is committed to resolving the situation. To file a valid damage claim, the buyer must inspect the artwork upon delivery; document the damage with clear photographs of both the packaging and the artwork before handling it; and contact the Gallery within forty-eight (48) hours of receipt, sending photographs to in**@************rt.com or via WhatsApp at +1 (253) 316-9529.

Once the damage is verified, the Gallery will offer, at its discretion, replacement of the artwork with another piece of equal value from the same series (subject to availability), professional repair of the artwork if feasible, or a full refund of the amount paid.

Claims for damage reported beyond the forty-eight (48) hour period will not be accepted, unless the buyer demonstrates that the damage was not visible at the time of delivery.

7.3 Right of withdrawal

For buyers located in Colombia, in accordance with Article 47 of the Colombian Consumer Statute (Law 1480 of 2011), you may exercise your right of withdrawal within five (5) business days following delivery of the product, without the need to justify your decision. To exercise this right, you must contact the Gallery by email or WhatsApp within the stated period and return the artwork in the same condition in which it was received, with its original packaging. Return shipping costs are the buyer’s responsibility. Once the artwork is received and its condition verified, a refund will be processed within thirty (30) calendar days.

For buyers located in the United States and other countries, all sales are final as stated in Section 7.1. If you believe there are extenuating circumstances, please contact us and we will review your case individually.


8. Classes, Workshops, and Courses

H3: 8.1 Reservations and payment

Registration for classes, workshops, and courses is completed through the Site, via WhatsApp, or directly at the studio. Full payment must be made before the class date to confirm the reservation.

8.2 Cancellation and rescheduling policy

Students may reschedule their class with a minimum of twenty-four (24) hours’ notice, subject to the Master’s availability. Rescheduling is permitted once (1) per reservation.

If the student fails to attend the class without having requested rescheduling at least twenty-four (24) hours in advance, the right to the class will be forfeited and no refund will be issued.

In the event that the Gallery must cancel or reschedule a class due to force majeure or the Master’s unavailability, the student will be offered a new date or a full refund of the amount paid, at the student’s choice.

8.3 Responsibility

Classes are conducted under the guidance of Master Artist Rafael Espitia, but artistic results depend on each student’s effort and ability. The Gallery does not guarantee specific outcomes. Basic materials are provided during the class unless otherwise stated in the workshop description.


9. Intellectual Property

All content on the Site, including but not limited to images of artwork, photographs, text, logos, graphic design, and source code, is the property of Rafael Espitia Perea and is protected by Colombian and international intellectual property and copyright laws.

It is expressly prohibited to reproduce, distribute, modify, publicly display, or use for commercial purposes any content from the Site without prior written authorization from the Gallery.

The purchase of an artwork grants the buyer ownership of the physical object (the painting) but does not transfer copyright or reproduction rights to the image of the artwork. The buyer may not reproduce the artwork for commercial purposes without authorization from the artist.


10. WhatsApp Auctions

The Gallery conducts periodic art auctions via WhatsApp. Participation in auctions implies acceptance of the following conditions: bids are binding and once an offer is made, the participant commits to completing the purchase if they are the winning bidder; the Gallery reserves the right to set a minimum starting price for each artwork; the winner will be notified via WhatsApp and must complete payment within forty-eight (48) hours; if payment is not completed within the stated period, the Gallery may offer the artwork to the next highest bidder; and shipping, packaging, and warranty conditions apply equally as for regular purchases through the Site.


11. Limitation of Liability

The Gallery shall not be liable for indirect, incidental, or consequential damages arising from the use of the Site or the purchase of products and services, beyond what is required by applicable law. We do not guarantee that the Site will be available without interruption or free from technical errors. We reserve the right to temporarily or permanently suspend access to the Site for maintenance or updates.


12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Colombia. Any dispute arising in connection with the use of the Site or the purchase of products and services shall be submitted to the jurisdiction of the competent courts in the city of Bogotá, Colombia.

For buyers located in the United States, these terms shall be interpreted in accordance with Colombian law, without prejudice to any mandatory consumer protection rights that may apply in your state of residence.


13. Modifications

The Gallery reserves the right to modify these Terms and Conditions at any time. Modifications will become effective upon publication on the Site. It is the user’s responsibility to review these terms periodically. Continued use of the Site after the posting of changes constitutes acceptance of the modified terms.
